Terms and Conditions of HKT education’s Education Offers

These Terms and Conditions of HKT education’s Education Offers (“Programme”, which definition includes any linked policies and notices) ("these Terms & Conditions"), apply to your visit, registration and/or use of the “Education Offers” Online Purchase Portals of our company, HKT Education Limited (“HKT education”) at https://www.hkteducation.com/education_offers/1/ ("Portal 1") and https://www.hkteducation.com/education_offers/2/ ("Portal 2") or our other designated website(s) (which includes all products and services available at those sites) (collectively, "Portals") available only in the Hong Kong Special Administrative Region of the People’s Republic of China (“Hong Kong”).  These Terms & Conditions apply to any visitors and registered members of the Portals.  

By visiting, registering as a member and/or using the Portals, you confirm that (i) you are at least 18 years old and have full legal capacity to enter into a binding contract; and (ii) you have read, understood and agreed to be bound by these Terms & Conditions. For persons under 18 years old, the purchase must be made by the students parent or legal guardian (“Authorised Adult”)  using Authorised Adult’s own Service Account and payment method, and the parent or legal guardian will be the contracting party responsible for the order and be bound by these Terms and Conditions.

1.          Access and Use: The Portals are for your personal use only.  You may access and make personal and non-commercial use of the Portals in accordance with these Terms & Conditions.  Unless otherwise expressly authorised herein, you may not reproduce, duplicate, copy, sell, resell, use, manipulate, tamper with, publish, transmit, distribute, perform, display, post, modify, create derivative works from, license or otherwise exploit the Portals or any part or whole of the Content (as defined in Clause 17 below).  You must not:

(a)         access or use the Portals in any way that causes, or is likely to cause, the Portals or access to it to be interrupted, damaged or impaired in any way;

(b)         access or use the Portals for fraudulent purposes or in connection with a criminal offence or other unlawful or illegal activity;

(c)         access or use the Portals for any competitive, trading, business or commercial purpose;

(d)         copy or permit any copying of the Content;

(e)         restrict or inhibit any other persons from using the Portals, including, without limitation, by means of "hacking" any part of the Portals or "hacking" or defacing any portion of the Portals;

(f)          modify, adapt, sub-license, translate, sell, reverse engineer, decompile or disassemble any software used in or in connection with the Portals, including the Software (as defined in Clause 17 below);

(g)         use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "data mine" or in any way reproduce or circumvent the navigational structure or presentation of the Portals or the Content;

(h)         reverse engineer any Content consisting of downloadable software;

(i)           hack, break into, access, use or attempt to hack, break into, access or use part of the Service, Content, any website(s) of any third parties, its content, and/or any data areas on our server(s) or that of any third parties without our prior written authorisation; and

(j)           make any unauthorised use of the Content.

2.           Linking: If you wish to share link(s) of the Portals or its webpages in any other websites ("Linked Website"), you must ensure that our content on the Linked Website must appear in the same way as it originally appears in the Portals or its webpages.  In linking the Portals or our webpages, you may not associate our content with any other content and shall not make any representation (whether express or by implication) that we promote or otherwise endorse the Linked Website, its content or any products or services to which the Linked Website relates.

3.           Purchases: To make purchases on the Portals, you must have registered a Service Account (as defined in Clause 6 below) as so required by us. When you place an order to purchase goods and/or services ("Goods") through the Portals, your order is an offer to us or relevant Supplier(s) (as defined in Clause 29 below) (as the case may be) to purchase the Goods which is accepted by us or relevant Supplier(s) (as the case may be) only when you complete your purchase on the Portals, unless we tell you otherwise.  In addition to these Terms & Conditions, purchase of any Goods on the Portals may be subject to other terms and conditions specific to the Goods ("Additional Terms").  Any Additional Terms will be made known to you prior to your purchase.  Where there are Additional Terms for the sale of any Goods, by placing an order to purchase such Goods, you agree to be bound by the Additional Terms.  In the event that there is any inconsistency between the Additional Terms and any part of these Terms & Conditions, the provisions in the Additional Terms shall prevail in respect of the purchase to which the Additional Terms apply.

4.           Purchase Eligibility: To enjoy the Programme, you must be an eligible customer for the respective Portal as indicated in the table below. For the list of eligible kindergartens, primary schools and secondary schools, please refer to registered school list under the Education Bureau at https://www.edb.gov.hk/tc/student-parents/sch-info/sch-search/index.html . For the list of tertiary institutions applicable for Portal 1 and Portal 2, please refer to: https://www.hkteducation.com/education_offers/promotions#schoollist . To make a purchase, you will be required to upload the image of the following document for our verification:

For Portal 1, information and images of supporting documents uploaded will be shared with Apple Asia Limited (“Apple”) for the purpose of verification in accordance with the PICS of Apple (please refer to https://www.apple.com/hk/en/legal/privacy/ ).

Our determination of your eligibility is final and binding. We have sole discretion to verify, accept, or reject any proof, and to suspend/reject orders if we reasonably suspect ineligibility.

 

5.           Purchase Quota:

(a)  Portal 1 (https://www.hkteducation.com/education_offers/1/):
The eligible purchase quota of each Service Account (as defined in clause 6) per calendar year is listed below. We reserve the right to claim the listed price of the Goods (if any, as indicated on the product page of the eligible item(s)) and the difference between the listed price and the Programme’s special offer if you purchase products exceeding the quota as indicated below. The quota is shared among all education offer programmes on the items below provided by other vendors, including but not limited to Senco, Straight A, Fortress, Broadway, StudioA, Chung Yuen, Sunning and Sunion.   If an Authorised Adult place an order for a minor child, that minor's student ID can only be used once for the whole Promotion Period. No repeat orders using the same student ID even across accounts or parents.

The eligible purchase quota of each Service Account (as defined in clause 6) per calendar year is listed below. We reserve the right to claim the listed price of the gifts (if any, as indicated on the product page of the eligible item(s)) and the difference between the listed price and the Programmes special offer if you purchase products exceeding the below quota. If there is no mention in the categories below, there will be no purchase quota.

6.           Service Account: When making purchases using your service account on the Portals ("Service Account"), you warrant that you are the owner of the Service Account. For the avoidance of doubt, minors shall seek your Authorised Adult’s guidance and assistance on your creation and use of the Service Account on the relevant Portals to make purchases of the Goods on your behalf. All activities that occur under your Service Account, whether or not the activities are conducted by you, shall be deemed activities to be  conducted by you, with your due authorisation.

(a)   Service Account would be valid across both platforms Portal 1 (https://www.hkteducation.com/education_offers/1/) and Portal 2 (https://www.hkteducation.com/education_offers/2/).

(b)   Staff of an eligible education institution or Tertiary students must use a valid education institution email address ending with edu.hk as their primary email address when registering for a Service Account on Portal 1 and Portal 2.

(c)   Kindergarten, primary, and secondary students may use any valid email address to create an account for Portal 2.

You may be required to provide information including but not limited to last name, school name, user type, education email address, copy of student ID and/or copy of staff ID (as the case may be) to enjoy the purchase eligibility across the other Portals. For purchase on Portal 1, the relevant information provided will be used by Apple to verify the customers’ eligibility and/or available quota under education offer(s).

 

7.           Ordering Method: You may place order via the Portals at (Portal 1: https://www.hkteducation.com/education_offers/1/ and Portal 2:  https://www.hkteducation.com/education_offers/2/ ) from 4 March 2026 at 12:00 until 31 December 2026 at 23:59 (“Promotion Period”).

8.           Payment and Pricing:

(a)         By ordering Goods on the Portals, you authorise us and/or relevant Supplier(s) (as the case may be) to charge the full amount of the Goods ordered and all related fees and charges (including but not limited to delivery fee) (collectively, "Fees") by the following payment methods (individually “Selected Payment Method”, and collectively “Selected Payment Methods”):

(b)         You must be authorised to use any of the Selected Payment Methods.

(c)         We have the right to, at any time and at our sole discretion, accept or reject your Selected Payment Method.  Unless otherwise provided in the terms of supply imposed by us or the Supplier (as the case may be), all prices are quoted in Hong Kong dollars and exclusive of any government service tax, value added tax or similar tax (if any) and are subject to change from time to time without prior notice.  Pricing or typographical errors may occur and in the event that an item of Goods is listed at an incorrect price, we shall have the right at our sole discretion to decline or cancel any orders placed for that item of Goods, or to contact you for purchase instructions based on the correct price information.  Goods purchased by you on the Portals shall be paid for in Hong Kong dollars.  The purchase price (or part thereof), once paid, is non-refundable under any circumstances, unless specified herein or we agree otherwise.

(d)         You hereby authorise us to charge your Selected Payment Method ("Card Account") the full amount of the Fees, by us or via our billing agent.  Your bank, the credit card issuing company and/or other relevant parties ("Bank") may charge you additional fees for making payment with your Selected Payment Method.  Please make enquiries with the Bank for details.  You warrant that you have obtained all necessary due authorisation for making payment via the Card Account.  By your Selected Payment Method, you are deemed to have consented or been obtained necessary consent (if applicable) to make purchase with such Selected Payment Method, irrespective of your age and capability, and we shall not entertain any dispute or complaint in relation to this.  Any disputes regarding the Fees on a statement for the Card Account must be raised within 30 days from the order acceptance date, notwithstanding, where relevant, any terms to the contrary in any cardholder agreement with the Bank.

9.           Availability:

(a)         All orders for Goods are subject to availability.  Goods available for purchase on the Portals may be provided by us or a Supplier (as the case may be).  We and our Affiliates (being PCCW Limited and its subsidiaries) do not sponsor, endorse or recommend, expressly or impliedly, any third party product, service, information or content provided through the Portals.

(b)         Goods available for purchase on the Portals may be subject to limitations and applicable terms of supply imposed by us or a Supplier (as the case may be) as shown in the Portals. Limitations and terms of supply may include countries to which Goods may be delivered; pricing and payment terms; order and delivery details; return, refund and cancellation policies; product and service warranties; and other contract terms, and they are subject to change from time to time without prior notice.  You should carefully review these limitations and terms of supply.

(c)         The specifications of the Goods, including sizes, dimensions, weights, measures, colours, capacities and other product features or descriptions, provided on the Portals are for reference and convenience purposes, and slight variations with actual specifications of the Goods may occur. The photos of the Goods are also for reference only.

(d)         All items of Goods included in the Portals are available only at our discretion or the discretion of Supplier (as the case may be) and such Goods may be withdrawn or varied at any time without prior notice.  Nothing included in the Portals shall constitute an offer on the part of the Portals to provide any Goods to any person.

10.        Order:

(a)         Upon your successful purchase of Goods on the Portals, an order confirmation will be sent to the email address you have provided on or around the purchase date, usually containing a delivery / collection note of the Goods (“Delivery Note” or “Collection Note”, as the case maybe) and an Authorisation Form (in case you may want to authorise someone to collect the Goods for and on your behalf).

(b)         We reserve the right to reject or cancel any order at our sole discretion for any reason (including but not limited to quota exceed, pricing mistakes, ineligibility, and where the Goods is out of stock or replenishing), even though you may have received a confirmation of your order from us or already paid for the Goods.  We will contact you through such means as we determine appropriate to inform you of such cancellation.

(c)         Once an order has been confirmed, there will be no refund of any amount.  If you want to (i) add Apple Care to your purchased Goods; (ii) change the chosen colour of your purchased Goods; and/or (iii) change your purchased Goods to other Goods with an amount equal to or higher value of your original order, you may amend your original order within 7 days from the date of the original order confirmation (the date of original order confirmation is Day 1 and the deadline for amending order is Day 7), by way of cancelling your original order and placing a new order under the same Service Account.  An administrative fee of HK$300 will be chargeable for cancellation of your original order.  The date of delivery / collection of the Goods will be shown on the new Delivery / Collection Note.  No changes to an order other than the aforesaid changes will be entertained.  Any order amendment after the said 7-day period will not be accepted.  

(d)         Notwithstanding Clause 10(a), we or Supplier (as the case may be) may send an order confirmation via such means as we or Supplier (as the case may be) determines as appropriate.  You may also view your order which has been accepted by us through the email invoice or order history section of your Service Account.

(e)         We reserve the right at our sole discretion (i) to specify the payment method for each purchase; (ii) to specify the pickup method for each purchase (whether by delivery, collection at our designated location(s) or other means so designated by us); (iii) to limit the quantity of the Goods purchased per order, per product or per service or per customer, and/or per Service Account; and/or (iv) to limit the amount that may be settled by a particular payment method during a period specified by us.  These restrictions may be applicable to orders placed by the same customer or Service Account or to orders that use the same billing and/or delivery / collection address.  We will notify you through the Portals should such limits be applied.  We further reserve the right at our sole discretion to prohibit sales to dealers or wholesalers.

(f)          All risk of and title to any purchased Goods are passed to you once your order for purchase is accepted by us.

(g)         With your purchase of Goods on the Portals, you may request for a free removal service for the same type and quantity of unwanted item listed under the Regulated Electrical Equipment (REE) of personal computer, desktop computer, tablet computer, laptop computer and notebook computer under the Product Eco-Responsibility Ordinance (Cap. 603 of the Laws of Hong Kong).  For details, please visit the Portals. 

11.        Supplier Warranty: The Goods purchased may be subject to terms and conditions of the warranty provided by our Suppliers ("Supplier Warranty").  We and our affiliates shall not in any way be liable, directly or indirectly, for any losses or damages which you, any user of the Goods or any other parties may incur or suffer as a result of the use of the Goods (or any part thereof), unless the same was caused by gross negligence or wilful default of us or our authorised representatives.  We and our Affiliates shall also not be responsible for any liability or risk regarding or arising from the Supplier Warranty.  In the event of fault, defect in workmanship and material or faulty design of such Goods, you may, return the Goods, directly to the Supplier for repair within the relevant warranty period.  We and our Affiliates shall not be responsible or liable for anything related to such Goods covered by the Supplier Warranty.

12.        Exchange Service:

(a)         Notwithstanding anything to the contrary of clause 11, within (i) 7 days from the date of delivery / collection / receipt (or deemed delivery / collection / receipt, as the case may be, depending on the method of pickup of the Goods) for Mac and iPad purchased from Portal 1; or (ii)14 days from the date of delivery / collection / receipt (or deemed delivery / collection / receipt, as the case may be, depending on the method of pickup of the Goods) for Mobile Phone, Notebook, Tablet, Watch, Gadgets, Kitchenware, Home Appliances purchased from Portal 2, you may be eligible to enjoy a one-time exchange service if, and only if, the Goods are found to be defective due to the following situations:

(i)           Does not boot;

(ii)         No power;

(iii)        Battery (if applicable) does not charge or does not hold charge;

(iv)        No video;

(v)         Internal input device failure (i.e. internal keyboard not responding); and/or

(vi)        Other hardware failure preventing basic operations of the Goods

(b)         Such exchange service will NOT cover any defects due to any defective pixel(s) on the LCD monitor, accidental or intentional physical damage to the Goods, spilled liquids, corrosion, animal and insect infestation, Fungi (as defined below), wear and tear, gradual deterioration, including (but not limited to) moisture, oxidation, misuse, abuse or damage to the Goods caused by non-authorised repair personnel.  For the purpose of these Terms & Conditions, the term “Fungi” shall mean any type or form of fungus, including (but not limited to) all forms of mould or mildew, and any mycotoxins, spores, scents, vapours, gas, or substance, including any by-products, produced or released by Fungi.  

(c)         Please bring any defective Apple Goods to Apple Store’s Genius Bar for checking.  If Apple finds the Goods to be defective due to one or more situations listed in Clause 12(a), Apple will issue a Work Authorisation Order to you.  Any request for an exchange of the defective Goods will be subject to our approval.  We will only proceed with exchanging the defective Goods upon your presentation to us of a Work Authorisation Order so issued by Apple.  We may also request for such other supporting evidence (such as videos and photographs) for our verification. (d)         For exchange, please return any defective Goods (other than Apple Goods) in original condition in its original packing and with the presentation of the original invoice of the location where the Goods were picked up.  Exchange of Goods is subject to availability of stocks.  In case of any disputes relating to any exchange of Goods, our decision shall be final and binding.

 

13.        Delivery / Collection:

(a)         Any given delivery times cannot be guaranteed.

(b)         We may specify the pickup method for each purchase of the Goods, whether by delivery to the delivery address you provide, collection at our designated location(s) or other means so designated by us.  Delivery of the Goods to such delivery address or collection of the Goods by you or such other person on your behalf at our designated location or by other means so designated by us shall be deemed due and proper delivery to you.

(c)         You may choose the date with timeslot and any of the following designated pickup locations to collect the Goods when placing your order. For the pickup locations and shop opening hours, please refer to https://www.hkteducation.com/education_offers/promotions#pickuppoint. We reserve the right to change the operating hours and pickup locations without prior notice.  For enquiry of operating hours, please call HKT Customer Service Hotline 1000.

(d)         If you have chosen to collect the Goods, you are required to collect the Goods at the date and location specified in the Collection Note.  You may collect the Goods in person or authorise a third party to collect.  If you collect the Goods in person, you are required to bring the ORIGINAL COPY of the following supporting documents upon collection of the Goods for verification:

(i)           Valid Student Cards (applicable to primary, secondary and tertiary students) /Student Handbook (only applicable to kindergarten students) and

(e)         If you choose to authorise a third party to collect the Goods, the authorised representative must present the ORIGINAL COPY of Authorisation Form signed by you, the Collection Note, and the photocopy of your above-mentioned Student Card / Staff Card / Student Handbook (where applicable) and his/her own identity document for verification.  The Authorisation Form is attached to the order confirmation email and can also be downloaded from the Portals.

(f)     If you (or authorised representative) fail(s) to present the documents listed above during collection of Goods, we reserve the right to reject the distribution of the Goods to you or the authorised representative.

(g)      Delivery service of Goods is available on Portal 1 with a fee. No delivery service will be provided for Goods purchased from Portal 2. Delivery service is available to designated areas in Hong Kong only.  For regions outside Hong Kong, delivery services are not available.  The delivery service may not be available to some outlying islands, remote or restricted areas (such as Sha Tau Kok) and such other locations as we may indicate from time to time.  The standard delivery charge is HK$160 per order, but delivery charge to Lantau Island (except Tung Chung) and other outlying islands is HK$820 per order and delivery charge to Tung Chung and Ma Wan is HK$340 per order.  On top of the delivery charge, there will be a surcharge of HK$50 per level for delivery to buildings without lift.  During the Promotion Period, purchase of iMac under the Programme will enjoy delivery service for free.  Items purchased under the same invoice are eligible for free delivery.  Such free delivery service is available to designated areas in Hong Kong and not applicable to Tung Chung, Ma Wan, Lantau Island and other outlying islands, remote or restricted areas (such as Sha Tau Kok).

(h)         If for any reason we cannot deliver the Goods to your delivery address, you may be required to collect the Goods yourself within a particular time frame at our designated location; in such event, if the Goods remain uncollected after our specified time frame (i.e. 30 days from the scheduled delivery date, unless otherwise specified by us), we shall have the sole discretion to dispose of the Goods and you will not be entitled to any refund or set off from us for any price paid, and any outstanding Fees in respect of such Goods will remain due and payable by you.

(i)           If the Goods are to be collected by you at our designated location at the specified date and if the Goods remain uncollected, we shall have the sole discretion to dispose of the Goods and you will not be entitled to any refund or set off from us for any price paid, and any outstanding Fees in respect of such Goods will remain due and payable by you.

(j)           In any event, if the Goods are not or cannot be received by you after our specified time frame for any reason whatsoever, we shall have the sole discretion to dispose of the Goods and you will not be entitled to any refund or set off from us for any price paid, and any outstanding Fees in respect of such Goods will remain due and payable by you.

(k)         While we shall endeavour to ensure that the Goods you ordered at the Portals will be available as soon as practicable, we do not in any way warrant that the Goods will be available by the date or by the delivery / collection method as per your confirmed order; and to the extent permitted by law, we shall not be responsible in any way for any loss or damages suffered by you or any person as a result of any delay in delivery / availability for collection of the Goods or any damage of the Goods during transportation.

(l)          If you received Goods which you had not ordered, please contact us at 1833 282  or email us at cs_eduoffer@hkteducation.com within 7 to 14 days from the date of receipt of the Goods.

(m)        If the Goods you ordered are damaged in transit, please contact us at 1833 282  or email us at cs_eduoffer@hkteducation.com  within 7 to 14 days from the date of receipt of the Goods.  Aside from iMac (which we will arrange pick up for the damaged Goods), you shall return the Goods unused and in its original packaging to us within 30 days from the date of receipt of the Goods unless otherwise specified by us. Subject to availability of the Goods, you may either get a replacement or a refund of such damaged Goods.

14.        Goods Collection Arrangement during Tropical Cyclone Warning & Rainstorm Signal:

1.  If the Tropical Cyclone Warning Signal No. 8 or above has been hoisted before the pickup locations’ operating hours mentioned above, or the Tropical Cyclone Warning Signal No. 8 or above is hoisted during the pickup locations’ operating hours mentioned above, the pickup locations will be closed.

2.  Until the Tropical Cyclone Warning Signal No. 8 to No. 3 or below, and there is still 3 hours or more before pickup locations’ closing hours mentioned above, the pickup locations will resume business within 3 hours after the Tropical Cyclone Warning Signal No. 8 is lowered.

3.  Upon the announcement of “extreme condition 極端情況” by the Government, and there is still 3 hours or more before pickup locations’ closing hours mentioned above, the pickup locations will resume business within 3 hours after the extreme condition announcement cancelled.

Black Rainstorm Warning

1.  If the Black Rainstorm Warning is issued before the pickup locations’ operating hours mentioned above, the pickup locations’ will be closed.  When the Black Rainstorm Warning is cancelled, if there is still 3 hours or more before pickup locations’ closing hours mentioned above, the pickup locations will resume business within 3 hours after the Black Rainstorm Warning is cancelled.

2.  If the Black Rainstorm Warning is issued during the pickup locations’ operating hours mentioned above, the pickup locations will continue to operate.

15.        Special Offers

(a)            Subject to the eligibility and terms and conditions set out below, you may be entitled to  special offer(s), namely Trade In Offer and/or Add-on discounts offer for AirPods 4 and AirPods Pro 3 (collectively, “Special Offers”), upon successful purchase of designated Goods on the Portals (both Portal 1 and 2) under the Programme.

                                                        i.            These Special Offers are limited in quantity and available on a first-come first-served basis. 

                                                      ii.            Unless otherwise specified, these Special Offers cannot be enjoyed by interest-free installments and cannot be used in conjunction with other discounts, offers or promotions, and are non-transferable or exchangeable for cash or other products/services.

(b)            Eligibility and terms and conditions of Trade-In designated device Offer:

                                                        i.            The promotion period of Trade-In Offer is valid from 4 March 2026 at 12:00 to 31 December 2026 at 23:59.

                                                      ii.            Customers who successfully purchased a desktop or notebook or tablet (each a “Designated Eligible Product”) with the Education Offer price on Portal 1 or Portal 2 and completed trade-in (after payment settled by MRR) at the designated website (https://trade.mrr.com.hk/client) using HKT education’s Education Offers sales invoice number within the promotion period are eligible for the Trade-In Offer. Customers can trade in one item per Designated Eligible Product purchased from the Portal(s). Upon fulfillment of the above conditions, they will be entitled to receive a HK$100 csl Handset and Accessory and Service e-gift voucher (“e-gift Voucher”) for each device that is successfully traded in according to the instructions above. Eligible customers must access and/or use the e-gift Voucher via the designated mobile app (as supplemented below).

                                                    iii.            The Trade-In Offer may only be applied once for each Designated Eligible Product purchased using HKT education’s Education Offers.

                                                     iv.            Eligible products for trade-in include smartphones, tablets, smartwatches, earbuds, and notebooks.

                                                      v.            The e-gift Voucher will be delivered within 7 working days after the trade-in has been completed, through the designated mobile app's "My Wallet" in the form of a coupon. Please refer to the requirements below to identify the mobile app you should download and register for a membership. Customers must download designated apps to get the coupon. You should refer to the  mobile phone number you used to register for the Education Offer Service Account when checking which mobile app you should download and register.

                                                     vi.            If the mobile number provided is a csl / 1O1O / Club Sim number, the coupon can be viewed on the corresponding mobile app of csl / 1O1O / Club Sim. If the mobile number provided is a non-csl / 1O1O / Club Sim number, customer can login csl app as a guest and the coupon can only be viewed on the csl mobile app.

(c)            Eligibility and terms and conditions of AirPods 4 and AirPods Pro 3 Offer:

                                                        i.            Students of designated tertiary institutions and Staff of designated kindergartens, primary schools, secondary schools, tertiary institutions who purchase designated Mac item(s) (including iMac, Mac mini, MacBook Air and MacBook Pro) under the Programme can enjoy one of the following options: (1) purchase the AirPods 4 active noise cancellation model at add-on price HK$899; or (2) purchase the AirPods Pro 3 model at add-on price HK$1,249.

                                                      ii.            To enjoy this offer, you must make an additional purchase at the checkout page before payment is made for the for the designated Mac item(s). This offer cannot be enjoyed after payment is completed. Once the additional purchase and payment are completed, the choice of the AirPods model cannot be changed.

                                                    iii.            This offer can only be enjoyed once per Mac item.  Each student and staff can enjoy this offer for up to 3 times. Limited availability (AirPods 4,700 units and AirPods Pro 3 300 units) and on first come first served basis.

16.        Health, Safety and Product Warnings: Certain Goods available on the Portals may not be suitable for children under a certain age or may require parents to supervise / demonstrate the use of such Goods by children (e.g. children’s products).  It is your sole responsibility to read and use the Goods in accordance with all applicable safety labels, health warnings, assembly instructions and other cautionary notices and directions, and to ultimately determine whether a particular product or service is appropriate for use by children taking into account their age and skill level. If you are in doubt about the use or safety of a particular Goods, contact the manufacturer or supplier in question, or consult the necessary professional for advice.

17.        Ownership of Content: The Portals, the design of the Portals and all of its materials, including, but not limited to, its software ("Software") or HTML code, scripts, text, artwork, photographs, images, designs, video, audio, marks, logos, content, information, and written and other materials that appear as part of the Portals (collectively, "Content") are owned, controlled or licensed to us and are protected by applicable intellectual property and other laws and international treaties.  All Content is provided under a limited licence as a service to you and may be used only for personal non-commercial use in accordance with these Terms & Conditions.  You will not acquire any intellectual property rights in or to the Portals by your access or use of the Portals in any way.

18.        Trademarks: All of our and our Affiliates’ trademarks, service marks, graphics and logos used in connection with the Portals are trademarks or registered trademarks of the relevant HKT group entities.  Other trademarks, service marks, graphics and logos used in the Portals may be the trademarks of their respective owners.  No licence for the use of the aforesaid trademarks is granted to you under these Terms & Conditions or by your registration as a member or use of the Portals.  Unauthorised use of the aforesaid marks in any manner is strictly prohibited.

19.        Personal Information Collection Statement: We may collect your personal data for the purpose of the Programme.  For the collection, use, transfer, sharing, processing, storage and/or retention of your personal data, please refer to the Personal Information Collection Statement of HKT education (https://www.hkteducation.com/education_offers/1/pub/media/import/PICS/Education_Offers-PICS(Eng).pdf ) and HKTs Privacy Statement (https://www.hkt.com/en/privacy-statement/for-customers/).  

 

20.        Other Businesses: We and our Affiliates are not responsible for and we and our Affiliates do not warrant or endorse, the offerings of any of these businesses or the content of their websites.  The Portals do not assume any responsibility or liability for the actions, products or content of any of these businesses or any third parties.  Certain products or services available on the Portals may require you to interact or deal with Supplier directly and we will not participate in any such interaction, dealing, transaction or negotiation which is solely between you and Supplier.  When ordering these products or services, you should be aware that you are solely responsible (and we cannot be held liable in any way) for all aspects of any interaction, dealing, transaction or negotiation in which you choose to participate with Supplier through the use of the Portals, including, without limitation, resolving any disputes, conflicts or claims of any nature which may arise from any such interaction, dealing, transaction or negotiation.

21.        Electronic Communications: We may communicate with you by posting notices through the Portals and other means as we determine to be appropriate.  You agree that all agreements, notices and other communications that we provide to you electronically or by SMS via mobile phone or other means as determined by us satisfy any legal requirement that such communications be in writing.

22.        Liability: In connection with your registration and use of the Portals and the supply of products, services and information purchased or obtained through the Portals:

(a)         to the extent permitted by law, all express or implied warranties, representations or statements relating to the Goods which are not contained on the Portals,  and the relevant Product Information Sheet / Key Information Sheet are excluded;

(b)         to the extent permitted by law, we and our Affiliates exclude all liability or responsibility for any cost, claim, damage or loss to you or any person whether direct or indirect of any kind, including loss of revenue, loss of profits or any consequential loss in contract, tort, under any statute or otherwise (including negligence) arising out of or in any way related to your use or purchase of the Goods on the Portals or the related Product Information Sheet / Key Information Sheet of the Goods; and

(c)         our total liability to you in connection with your purchase of the Goods on the Portals (including but not limited to any repairing of the Goods and the cost of re-supplying the Goods) shall not in any event exceed the total amount paid by you for the Goods.

23.        Alteration of Service or Amendments to the Conditions: We reserve the right to make changes to the Portals, these Terms & Conditions and all related policies and notices at any time; any such amendments shall be effective as soon as an amended version is posted on the Portals (unless otherwise specified by us).  Your use of the Portals following any such amendments constitutes your agreement to follow and be bound by the terms as amended.  You will be subject to these Terms & Conditions and all related policies and notices in force at the time you use or visit the Portals, or when you order Goods on the Portals.  You should visit the Portals from time to time to review the current Terms & Conditions of the Portals.  If any provision of these Terms & Conditions or related policies or notices is deemed invalid, void, or for any reason unenforceable, that provision will be deemed severable and will not affect the validity and enforceability of any remaining provisions.

24.        Causes Beyond Our Reasonable Control: We will not be held responsible for any delay or failure to comply with our obligations if the delay or failure arises from any cause which is beyond our reasonable control.

25.        Service Account Suspension: We may at any time suspend your Service Account for use of any part or the whole of the Portals for any reason and without prior notice to you, including without limitation where: (a) you have breached or we have reason to believe that you have breached any provision of these Terms & Conditions; or (b) we are required to do so by law, regulatory requirements, court order, Stock Exchange requirements or request of other competent authorities.  In the event that your Service Account is suspended pursuant to this Clause, we may suspend your access or use of any other services provided by us or our Affiliates through your Service Account or otherwise and any obligations owed to us under any applicable terms and conditions shall not be affected.

26.        Assignment: We may transfer, assign, novate and/or sub-contract the whole or any part of the rights and/or obligations in relation to the Portals or contained in these Terms & Conditions to any person and/or entity at any time without your consent.  We may also use any of our Affiliates, agents and/or subcontractors to perform any of our responsibilities in relation to the Portals.

27.        Disputes: In case of any disputes in connection with the Portals and the Goods (including but not limited to these Terms & Conditions), our decision shall be final, conclusive and binding.

28.        Governing law and Jurisdiction: These Terms & Conditions are governed by and construed in accordance with the laws of Hong Kong.  You agree to submit to the exclusive jurisdiction of the Hong Kong courts.

29.        Miscellaneous: The English version of these Terms & Conditions shall prevail over the Chinese version (if any).  References to "we", "us" and "our" are references to HKT Education Limited in relation to the provision of the Portals.  References to "Supplier" are references to any third party supplier of Goods from whom you may purchase Goods through the Portals in accordance with these Terms & Conditions.
